Law and Victim's Rights ARTICLE 1, SECTION 12. CRIMINAL ADMINISTRATION.
Excessive bail shall not be required, nor excessive fines imposed, nor cruel
and unusual punishments inflicted.
Criminal administration shall be based upon the following:
the need for protecting the public, community condemnation of the offender,
the rights of victims of crimes, restitution from the offender, and the
principle of reformation.
ARTICLE 2, SECTION 24. RIGHTS OF CRIME VICTIMS.
Crime victims, as defined by law, shall have the following rights as provided
by law:
the right to be reasonably protected from the accused through the imposition
of appropriate bail or conditions of release by the court;
the right to confer with the prosecution;
the right to be treated with dignity, respect, and fairness during all phases
of the criminal and juvenile justice process;
the right to timely disposition of the case following the arrest of the
accused;
the right to obtain information about and be allowed to be present at all
criminal or juvenile proceedings where the accused has the right to be
present;
the right to be allowed to be heard, upon request, at sentencing, before or
after conviction or juvenile adjudication, and at any proceeding where the
accused's release from custody is considered;
the right to restitution from the accused; and
the right to be informed, upon request, of the accused's escape or released
from custody before or after conviction or juvenile adjudication.

Adult sex offenders or child kidnappers and juveniles tried and
convicted as adults |
| Information Collected: |
Photograph, fingerprints, name (including all aliases), address,
place of employment, DOB; driver's license number; description, license numbers,
and vehicle identification numbers of motor vehicles the sex offender or child
kidnapper has access to regardless of whether that access is regular or not; any
identifying features of the sex offender or child kidnapper; and a statement
concerning whether the offender or kidnapper has had treatment for a mental
abnormality or personality disorder since the date of conviction for an offense
requiring registration under this chapter. |

| Timeframe for Registration: |
The Alaska Sex Offender or child kidnapper shall register: within the
30-day period before release from an in-state correctional facility; by the next
working day following conviction for a sex offense or child kidnapping if the
Alaska Sex Offender is not incarcerated at the time of conviction; or by the next
working day of becoming physically present in the state. |

One aggravated sex offense; or two or more sex offenses, two or
more child kidnappings, or one sex offense and one child kidnapping. 15 years
following the sex offender's or child kidnapper's unconditional discharge from a
conviction for a single sex offense that is not an aggravated sex offense or for
a single child kidnapping if the Alaska Sex Offender or child kidnapper has supplied
proof that is acceptable to the department of the unconditional
discharge. |

The public has access to information on registrants through
Alaska's Internet site. All offenders required to register, whether they are
registered, have never registered, registered but are out-of-compliance, or in
jail, will be on the Internet The public may also obtain information from the
local police station, and they may receive hard copy reports on individual sex
offenders through the SORCR office in response to individual requests. |
