Law and Victim's Rights
(1)The right to respect Crime victims, as defined by law, shall have the
following right to be treated with fairness and respect for their dignity and
privacy throughout the criminal justice process.
(2)The right to be informed Crime victims, as defined by law, shall have
the following right to notification of court proceedings. Crime victims, as
defined by law, shall have the following right to information about the
conviction, sentence, imprisonment, and release of the accused.
(3)The right to be present Crime victims, as defined by law, shall have
the following right to be present at the trial and all other court proceedings
on the same basis as the accused. Crime victims, as defined by law, shall
have the following right to have present at all court proceedings, subject to
the rules of evidence, an advocate or other support person of the victim's
choice.
(4)The right to be heard Crime victims, as defined by law, shall have the
following right to confer with the prosecution. Crime victims, as defined by
law, shall have the following right to make a statement to the court at
sentencing.

regarding victims' rights.
Section 8.1 CRIME VICTIM'S RIGHTS
(a) Crime victims, as defined by law, shall have the following rights as
provided by law:
(1) The right to be treated with fairness and respect for their dignity and
privacy throughout the criminal justice process. (2) The right to
notification of court proceedings. (3) The right to confer with the
prosecution. (4) The right to make a statement to the court at
sentencing. (5) The right to information about the conviction, sentence,
imprisonment, and release of the accused. (6) The right to timely disposition
of the case following the arrest of the accused; (7) The right to be
reasonably protected from the accused throughout the criminal justice process.
(8) The right to be present at the trial and all other court proceedings on
the same basis as the accused, unless the victim is to testify and the court
determines that the victim's testimony would be materially affected if the
victim hears other testimony at the trial. (9) The right to have present at
all court proceedings, subject to the rules of evidence, an advocate or other
support person of the victim's choice. (10) The right to restitution.
(b) The General Assembly may provide by law for the enforcement of this
Section.
(c) The General Assembly may provide for an assessment against convicted
defendants to pay for crime victims' rights.
(d) Nothing in this Section or in any law enacted under this Section shall be
construed as creating a basis for vacating a conviction or a ground for
appellate relief in any criminal case.

| Offenders Required to Register: |
Any adult or juvenile found guilty of any of the following
crimes: Indecent Solicitation of a child; Sexual Exploitation of a child;
Soliciting for a Juvenile Prostitute; Keeping a place of Juvenile Prostitution;
Patronizing a Juvenile Prostitute; Juvenile Pimping; Exploitation of a Child;
Child Pornography; Criminal Sexual Assault; Aggravated Criminal Sexual Assault;
Predatory Crimial Sexual Assault of a Child; Criminal Sexual Abuse, when a
felony; Aggravated Criminal Sexual Abuse; Ritualized Abuse of a Child; Forcible
Detention, if the victim is under 18 years of age; Indecent Solicitation of an
Adult; Soliciting for a Prostitute, if the victim is under 18 years of age;
Pandering, if the victim is under 18 years of age; Patronizing, if the victim is
under 18 years of age; Pimping, if the victim is under 18 years of age;
Kidnapping; Aggravated Kidnapping; Unlawful Restraint Aggravated Unlawful
Restraint; First Degree Murder of a Child; Child Abduction; and Attempts to
commit these offenses. |

Name, Address, DOB, and offense for which convicted. Photograph,
fingerprints, DNA. Offender not allowed to change name within 10-year
duration. |

| Timeframe for Registration: |
A sex offender can report a change of address by writing the
local jurisdiction they are currently registered with of their new address
within 10 days of their move. Upon moving to the new residence, the sex offender
must register in person within 10 days with the new law enforcement agency of
residence. A sex offender visiting in the State of Illinois more than 10 days
will be required to register with the local law enforcement jurisdiction of the
person they are visiting. This means cumulative days; it does not necessarily
have to be 10 consecutive days. |

Yes, regardless if state, federal, or out-of-country
offense. |
| Duration of Requirements: |
A sex offender who is required to register must register in
person annually for a 10-year period. A sex offender sentenced to probation will
start his/her 10-year registration period from the date of his conviction or if
sentenced to a hospital or Department of Corrections, the 10-year period starts
from the date of parole, release or discharge. A person who has been adjudicated
as Sexually Dangerous, or Sexually Violent must register with the law
enforcement agency having jurisdiction at his or her place of address every 90
days for natural life. |
| Verification of Address: |
State Police verifies addresses of all sex offenders annually,
and also conducts random checks for some sex offenders. |
| Penalties for Non-Compliance: |
Registrants who fail to comply are guilty of a Class 4 felony. In
addition to any other penalty required by law, be required to serve a minimum
period of 7 days confinement in the local county jail. The court shall impose a
mandatory minimum fine of $500 for failure to comply. These fines shall be
deposited in the Sex Offender Registration Fund. |
| Access to Information: |
The name, address, date of birth, and offense or adjudication for
Registered Sex Offenders shall be open to inspection by the public. Every
municipal police department shall make available at its headquarters the
information on all Registered Sex Offenders. The sheriff shall also make
available at his or her headquarters the information on all registered sex
offenders who live in unincorporated areas of the county. The information shall
be made available for public inspection according to procedures set by the
department or sheriff, or upon request of any person presented in writing, in
person, or by telephone. The law enforcement agency may make available the
information on all sex offenders residing within the county. |
