Law and Victim's Rights
(1)The right to respect Victims of crime, as defined by law, shall have
the right to be treated with fairness, dignity and respect throughout the
criminal justice process.
(2)The right to be present Victims of crime, as defined by law, shall have
the right to to be informed of and present during public hearings.
(3)The right to be heard Victims of crime, as defined by law, shall have
the right to confer with the prosecution.

Indiana Constitutionally Guarantees the Following Rights to Its Victims of
Crime:
Victims of crime, as defined by law, shall have the right to be treated with
fairness, dignity and respect throughout the criminal justice process; and, as
defined by law, to be informed of and present during public hearings and to
confer with the prosecution, to the extent that exercising these rights does not
infringe upon the constitutional rights of the accused.

| Offenders Required to Register: |
Adult sex offenders; adults convicted of kidnapping if the victim is less
than eighteen (18) years of age; or of criminal confinement, if the victim is
less than eighteen (18) years of age and if the conviction took place after
6/30/98. Rape, criminal deviant conduct, child molestation, child exploitation,
vicarious sexual gratification, child solicitation, child seduction, sexual
battery, sexual misconduct with a minor (A or B felony) and incest if the
conviction took place after 6/30/94. |

Aliases, date of birth, physical description, social security number,
drivers license number, conviction and sentence imposed if applicable.
Department of Correction collects DNA samples. |

Within 7 days of arriving at intended residence; 7 days of changing address
and within 7 days of moving into State. |

| Duration of Requirement: |
An offender's duty to register expires ten (10) year after the date the
offender is released from prison or any other facility operated by the
department of correction, placed on parole, or placed on probation, whichever
occurs last. Sexual predators must register annually until released by court.

| Verification of Address: |
Local law enforcement agency shall do the following: Mail each offender a
verification form to the offender's listed address at least one (1) time per
year, beginning one (1) year after the date the offender is: released from a
correctional facility operated by the department of correction; placed on
parole; or placed on probation; whichever occurs last. Mail a verification form
to each offender who is designated a sexually violent predator at least once
every ninety (90) days. |
| Penalties for Non-Compliance: |
Class D felony or if they have a previous conviction unrelated to the
current conviction it is a class C felony. |
| Access to Information: |
The general public has access to SVOR data in hard copy in public libraries
throughout the State and on the State of Indiana website on the Internet. Since
July 1, 1994, it also has been made available on computer diskette. The SVOR
data available to the public does not include street addresses, but does reflect
all databases. |
| Confidentiality Provision: |
Any person who misuses limited criminal history information commits a Class
A misdemeanor. |
