Offenders Required to Register: An individual who has been convicted or adjudicated of a criminal offense against a minor, sexual exploitation, or a sexually violent crime or who was on probation, parole, or work release status, or who was incarcerated on or after July 1, 1995 is required to register.
Information Collected: Fingerprints, social security number, photograph, current address, telephone number and additional relevant information not including information identifying the victim.
Administrating Agency: Department of Public Safety, county sheriff.
Timeframe for Registration: Within 5 days of release or establishing residence in the state; within 5 days of changing residence.
Applies to Out of State Offenders: Yes
Duration of Requirement: 10 years; indeterminately if person is a sexually violent predator; 10 years recommences upon subsequent convictions for sex offenders. Lifetime for second conviction.
Verification of Address: Annually - the department sends a verification form by mail that must be completed and mailed back within 10 days; sexually violent predators will have their addresses verified every three months.
Penalties for Non-Compliance: First offense is an aggravated misdemeanor; second and subsequent offenses are Class D felonies; however, a person who fails to register and commits another offense is guilty of a Class C felony. If person is on parole, probation, or work release, failure results in automatic revocation.
Access to Information: Affirmative notification can be made by contacting the sheriff or police with a name plus one of the following; birth date, address or SSN. Since March 17, 2000 the public has Internet access to a list of our "at risk" offenders. The site is searchable by name, city, county, or zip code, and contains information including the offenders name, address, physical description, DOB, and conviction information, as well as a photo of the offender.
