Minnesota Megan's Law and Victim's Rights

Offenders Required to Register: Applies to sex offenders who are released, sentenced, or adjudicated delinquent on or after January 1, 1997.
Information Collected: Fingerprints, photo, DNA sample (required by another statute), other identifying information.
Administrating Agency: Minnesota Department of Public Safety; Bureau of Criminal Apprehension (BCA).
Timeframe for Registration: Upon conviction; immediately upon release from a secure state corrections facility or state hospital facility; prior to entering state if accepted while on supervised release/probation with same or similar crime; 5 days prior to changing address; out of state offenders no longer under supervision have 5 days after moving into state.
Applies to Out of State Offenders: Yes, if under supervised release/probation; acceptance of an offender under interstate agreement is conditional on the offender registering, with other requirements; those convicted in the last 10 years for same or similar crime.
Duration of Requirement: 10 years or length of parole/probation, whichever is longer.
Verification of Address: No, but local law enforcement is asked to physically verify offender's reported address.
Penalties for Non-Compliance: 1st failure - gross misdemeanor, and adds 5 years to registration requirement; 2nd failure - felony.
Access to Information: Notification process is dependent upon the offender's assessed level of risk to re offend: Low risk (level 1), information maintained within law enforcement agencies may share with other law enforcement agencies. This information must be disclosed, upon request, to victims or witnesses to the offense and if designated to release by the prosecuting attorney. Moderate risk (level 2), law enforcement agencies may disclose information to agencies and groups that the offender is likely to encounter (public and private schools, day care facilities, and other agencies.) High risk (level 3), law enforcement agencies also shall disclose information to the other members of the community with whom the offender is likely to encounter, unless there is a public safety risk or a victim identity issue. Exact methods of notification are subject to peace officers' standard and training board policy. For high-risk offenders, community education and safety meetings are by policy.

Notification process is dependent upon the offender's assessed level of risk to reoffend: low risk (Tier I), information maintained within law enforcement agencies and may be disclosed to victims or witnesses to the offense; moderate risk (Tier II), law enforcement agencies may disclose information to agencies and groups that the offender is likely to encounter (public and private schools, day care facilities, and other agencies or groups dealing with children or women); high risk (Tier III), law enforcement agencies also may disclose information to other members of the community whom the offender is likely to encounter. Exact methods of notification are subject to judgment by local law enforcement. For high-risk offenders, community meetings are recommended.
