Law and Victim's Rights
Article 1, Section 8
- [Pertains to the rights of the defendant]
- The legislature shall provide by law for the rights of victims of
crime, personally or through a representative, to be:
(a) Informed, upon
written request, of the status or disposition of a criminal proceeding at any
stage of the proceeding; (b) Present at all public hearings involving the
critical stages of a criminal proceeding; and (c) Heard at all proceedings for
the sentencing or release of a convicted person after trial.
- Except as otherwise provided in subsection 4, no person may maintain
an action against the state or any public officer or employee for damages or
injunctive, declaratory or other legal or equitable relief on behalf of a victim
of a crime as a result of a violation of any statute enacted by the legislature
pursuant to subsection 2. No such violation authorizes setting aside a
conviction or sentence or continuing or postponing a criminal
proceeding.
- A person may maintain an action to compel a public officer or
employee to carry out any duty required by the legislature pursuant to
subsection 2.

| Offenders Required to Register: |
All offenders convicted of certain sex offenses and crimes against children
after 1956, and released on parole or probation are subject to risk assessment
and notification dependent upon assigned level of risk. |

Fingerprints, photo, address, DNA and other identifying
information. |

Department of Motor Vehicles/Public Safety Division, local law
enforcement. |

Within 48 hours of arrival in a county; 48 hours of changing address, within
48 hours of moving into State. |

Life; offender may apply to district court for order relieving him of duty
to register after 15 consecutive years. |

| Access to Information: |
Tier 1 offenders: Local law enforcement agencies shall share information
with other appropriate law enforcement agencies. Tier 2 offenders: Local law
enforcement may also disclose relevant, necessary and accurate information to
public and private schools, child day care centers, family day care providers,
businesses and organizations that serve primarily children, women, or vulnerable
adults. Tier 3 (high risk) offenders, the law enforcement agency where the
offender resides notifies not only other law enforcement agencies, schools, and
youth organizations, but also the general public "through means designed to
reach members of the public likely to encounter the sex offender." |
