Offenders Required to Register: Sex Offenders: Individuals who have pled guilty or been found guilty of the following offenses: gross sexual imposition; continuous sexual abuse of a child; sexual imposition; corruption or solicitation of minors; sexual abuse of wards; sexual assault; incest; surreptitious intrusion (second offense only); sexual performance by children (all offenses). Offender against Children: child abuse; criminal child abuse; homicide offenses (all); assault (felony only); aggravated assault; reckless endangerment (felony only); terrorizing; stalking (felony only); kidnapping; felonious restraint; prostitution (all offenses) and criminal child abuse.
Information Collected: Fingerprints, photo, place of employment, date and place of conviction, description of offense, other identifying information such as height, weight, hair color, eye color, and race. DNA samples are collected from individuals who have been convicted in North Dakota in the following cases: continuous sexual abuse; gross sexual imposition; sexual imposition; corruption of a minor; solicitation of a minor; sexual abuse of a ward; sexual assault (victim age 15-17); incest and other offenses and the court found at sentencing that the defendant had engaged in a non-consensual sexual act or sexual contact with another person during, in the course of, or as the result of the offense.
Administrating Agency: State Bureau of Criminal Investigation, local law enforcement, State Department of Correction and Rehabilitation.
Timeframe for Registration: Within 10 days of release; 10 days of changing address, within 10 days of moving into state.
Applies to Out of State Offenders: Yes
Duration of Requirement: 10 years after the date of conviction or release from incarceration, whichever is later. Lifetime if the offender has at least two convictions or if the offender has been determined to be a sexually violent predator.
Verification of Address: Yes
Penalties for Non-Compliance: 1st offense Class A misdemeanor 90 days in jail and 1 year probation. Class C felony for subsequent failures to comply.
Access to Information: Information is readily available to the public upon request. Relevant and necessary registration information must be disclosed to the public by a law enforcement agency if the agency determines that the individual registered under this section is a public risk and disclosure of the registration information is necessary for public protection.
Confidentiality Provision: Only regarding juvenile information.
Number Registered: 1,227 total convicted offenders. 677 sex offenders, 41 offenders against children, 57 incarcerated and registered offenders, 139 incarcerated but not registered and about 300 who have moved out of state.
