Law and Victim's Rights
(1)The right to respect (a) Victims of criminal offenses shall be accorded
fairness, dignity, and respect in the criminal justice process
(4)The right to be heard (a)Section 10a., and, as the General Assembly
shall define and provide by law, shall be accorded rights to reasonable and
appropriate notice, information, access, and protection and to a meaningful role
in the criminal justice process.

ARTICLE I, SECTION 10a
Section 10a. Victims of criminal offenses shall be accorded fairness,
dignity, and respect in the criminal justice process, and, as the General
Assembly shall define and provide by law, shall be accorded rights to reasonable
and appropriate notice, information, access, and protection and to a meaningful
role in the criminal justice process. This section does not confer upon any
person a right to appeal or modify any decision in a criminal proceeding, does
not abridge any other right guaranteed by the Constitution of the United States
or this Constitution, and does not create any cause of action for compensation
or damages against the State, any political subdivision of the State, any
officer, employee, or agent of the

| Offenders Required to Register: |
Sexual predators: a person who is convicted of a sexually violent offense
and is found by the sentencing court to be a sexual predator. Habitual sex
offenders: a person previously convicted of one or more sexually oriented
offenses and sentencing judge determines community notification is necessary for
that individual. The act applies to anyone released after January 1, 1997
regardless of when the individual was sentenced. |

misdemeanor. If convicted of a felony, the charge for failure to register is a

Written notice of a habitual sex offender or sexual predator is provided to
the following persons within the specified geographic notification area (defined
in administrative rule as the entire school district in which an offender
resides): local law enforcement, all occupants of residences adjacent to the
offender's place of residence; the executive director of the public children
services agency; the superintendent of each board of education of a school
district; the appointing or hiring officer of each nonpublic school; the
director, head teacher, or elementary principal of each preschool program; the
administrator of each child day care center; and, the president or other chief
administrative officer of each institution of higher education. |
