| Offenders Required to Register: |
All persons convicted of serious sex crimes that are no longer incarcerated,
including federal, military, out-of-state convictions and certain adjudicated
juveniles, must register if residing in South Dakota for more than thirty days.
Any person convicted of any of the following crimes regardless of the date of
the commission of the offense or the date of conviction: Rape, Sexual contact
with a minor under sixteen if committed by an adult and the adult is convicted
of a felony; Sexual contact with a person incapable of consenting if committed
by an adult; Incest if committed by an adult; Photographing a child in an
obscene act Possession of child pornography; Sale of obscene pictures of a
child; Kidnapping, if the victim of the criminal act is a minor; Promotion of
prostitution of a minor; Criminal pedophilia; Felony indecent exposure or
indecent exposure; or an attempt to commit any of the crimes listed in this
section. Juvenile registration is not retro-active, and they must be fifteen
years of age or older. A court order can remove these juveniles after ten years
in the registry. |

Name and all aliases used; Complete description, photographs, and
fingerprints; Residence, length of time at that residence, and length of time
expected to remain at that residence; the type of sex crime convicted of; and
the date of commission and the date of conviction of any sex crime
committed. |

Within 10 days of entering state; 10 days of changing address. |
| Applies to Out of State Offenders: |
Yes. (Any crime committed in another state if that state also requires that
anyone convicted of that crime register as a sex offender in that state; any
federal crime or court martial that would constitute a sex crime under federal
law - effective 7/1/02) |
| Duration of Requirement: |
Lifetime. Juveniles can petition the court for removal from sex offender
registry after 10 years. Adult sex offenders who successfully complete probation
can apply for dismissal and discharge if they originally received a suspended
imposition of sentence. Registrants are removed from registry if they move out
of state. |
| Verification of Address: |
The CDI shall mail a nonforwardable verification form at least once annually
to the last reported address. |
| Penalties for Non-Compliance: |
First failure - Class 1 misdemeanor; subsequent failure - Class 6
felony. |
| Access to Information: |
The Division of Criminal Investigation (DCI) sexual offender registration
file is available to all law enforcement agencies on a twenty-four hour basis,
but is not open to inspection by the public. However, the registration
information is public at the local law enforcement level and may be viewed by
the public. |
| Confidentiality Provision: |
Any person who commits any crime as a result of information gained through
the sex offender registry or through public information pursuant to § 22-22-40
is guilty of a Class 6 felony. Such liability is in addition to any other civil
or criminal penalties. |
