Law and Victim's Rights ARTICLE I, SECTION 9m
Victims of crime.
This state shall treat crime victims, as defined by law, with fairness,
dignity and respect for their privacy. This state shall ensure that crime
victims have all of the following privileges and protections as provided by law:
- timely disposition of the case;
- the opportunity to attend court proceedings unless the trial court
finds sequestration is necessary to a fair trial for the defendant;
- reasonable protection from the accused throughout the criminal
justice process;
- notification of court proceedings;
- the opportunity to confer with the prosecution;
- the opportunity to make a statement to the court at
disposition;
- restitution;
- compensation;
- and information about the outcome of the case and the release of
the accused.
The legislature shall provide remedies for the violation of this section.
Nothing in this section, or in any statute enacted pursuant to this section,
shall limit any right of the accused which may be provided by law.

| Offenders Required to Register: |
Adult and juvenile sex offenders who, on or after 12/25/93, were:
sentenced; in an institutional setting; discharged; or on field
supervision. |

Name, aliases, DOB, identifying information, crime, date of
conviction, county or state of offense, date or release, address, place of
employment, place of school enrollment, and DNA sample. |

State Department of Corrections. |
| Timeframe for Registration: |
Before release from prison, within 10 days after placement on
supervision, or before entering Wisconsin from another state. Changes to
registry information must occur prior to changing address, school enrollment, or
employment. It must also occur at least 10 days in advance of relocation to
another state. |

| Duration of Requirement: |
Before release from prison, within 10 days after placement on
supervision, or before entering Wisconsin from another state. Changes to
registry information must occur prior to changing address, school enrollment, or

| Verification of Address: |
Life registrants must verify their registry information with the
Department of Corrections every 90 days. All other registrants must verify their
information annually, at a minimum. All registrants are subject to random and
unscheduled verification activities by the Department of Corrections. All
registrants are notified of their verification requirements, and must comply as
directed. |
| Penalties for Non-Compliance: |
Up to $10,000 fine and/or up to 9 months imprisonment for the
first offense. Up to a $10,000 fine and 5 years imprisonment for 2nd and
subsequent offenses. |
| Access to Information: |
Victims and victims' families have direct access to SORP
information related to their offender(s) via a toll-free number. Victims may
also request written notification of the offender's change of address or similar
information. The general public can access basic SORP data on a specific person,
but they must provide the name, date of birth, and the Social Security Number or
the driver's license number of the subject of their inquiry. Registry
information will also be available online as of June 1, 2001 at http://offender.doc.state.wi.us/public/.
Affirmative community notification is the responsibility of the local law
enforcement agency. |
| Confidentiality Provision: |
Wisconsin law provides criminal penalties for any person who
deliberately misuses registry information, including the use of information from
the registry to harass, intimidate, or discriminate unlawfully against a person.
Wisconsin law generally prohibits the release of any registry information that
identifies victims. Wisconsin law also generally prohibits the release of
information to the public regarding a juvenile, or regarding any proceeding that
occurred when an adult registrant was a juvenile. |
